Trademark, Service Mark and Copyright Policy Statement and
Agreement
I.
TRADEMARKS AND SERVICE MARKS
Peter Koestenbaum ("PK") has developed a significant
amount of (i) goodwill in, and (ii) wide spread recognition
in his LEADERSHIP DIAMOND®, IDEABANK®, DR/E DIAMOND REVERSE
ENGINEERING™ [registered trademark pending] and PHILOSOPHY-IN-BUSINESS™
trademarks and service marks (the "PK Trademarks"). PK will
actively pursue any parties who infringe or misuse his trademarks
or service marks. PK does, however allow other companies
or individuals to use the PK Trademarks, if certain guidelines
are followed. The guidelines listed below will assist you
in properly using the marks owned by PK, when appropriate,
in referring only to those products or services offered
by or obtained from PK under the PK Trademarks.

Use the appropriate trademark designation to identify
PK's proprietary rights (e.g., ® for registered marks;
™ for unregistered trademarks; SM for unregistered service
marks).

Recognize, in writing, PK's ownership of the mark, wherever
a PK Trademark is used. For example: "LEADERSHIP DIAMOND®"
is a registered trademark of Peter Koestenbaum, or PHILOSOPHY-IN-BUSINESSSM
is a service mark of Peter Koestenbaum.

Refrain from using PK's trademarks and service marks on
your packaging and advertising except to accurately identify
Peter Koestenbaum and his products and services, unless
PK's prior written consent has been obtained.

Obey all federal and state statutes and laws regarding
unfair competition and trademark infringement.
II.
COPYRIGHT
PK has spent a considerable amount of time and money creating
his copyrighted works which are available on his server,
web sites, e-mail enclosures of his materials, facsimile
copies of his works, printed handouts and on all other electronic
and magnetic media and PK actively protects the proprietary
and copyrighted subject matter contained on all such media.
By downloading any of PK's copyrighted works from PK's web
site or from e-mail attachments or by obtaining the copyrighted
materials in the form of printed handouts or via facsimile
or from any other electronic or magnetic media, the recipient
thereof hereby agrees to all the terms and conditions as
set forth herein. PK hereby grants the recipient the limited
permission to use such copyrighted works subject to the
following terms and guidelines:

The copies are being made strictly for personal use of
the recipient only. No copies or reproduction shall be
made for the sale of PK's copyrighted materials or for
the commercial use of such works in conducting seminars
or other types of programs for which monetary consideration
is paid for the programs or materials, without the prior
written consent of PK.

That when authorized by PK, ensure that PK's copyright
notice, as shown in the applicable works also appears
in all copies which are distributed. For example, "© 1999
Peter Koestenbaum, All Rights Reserved."

Take appropriate steps to ensure that PK's copyrighted
works on any and all media are not modified without the
prior written consent of Peter Koestenbaum.

Ensure that no derivative works are made based upon PK's
copyrighted works without PK's prior written consent.
III.
MISCELLANEOUS
PK AND HIS RELATED ENTITIES MAKE NO REPRESENTATIONS OR WARRANTIES
ABOUT THE ABSOLUTE ACCURACY OR SUITABILITY OF THE INFORMATION
OR DOCUMENTS PROVIDED ON THIS SERVER, WEB SITES E-MAIL ENCLOSURES
OF HIS MATERIALS, FACSIMILE COPIES OF HIS WORKS, PRINTED
HANDOUTS AND OTHER ELECTRONIC AND MAGNETIC MEDIA FOR ANY
PURPOSE. ALL SUCH INFORMATION AND DOCUMENTS ARE PROVIDED
"AS IS"WITHOUT WARRANTIES OF ANY KIND. PK AND HIS RELATED
ENTITIES HEREBY DISCLAIM ALL WARRANTIES RELATED TO THE USE
OF THE INFORMATION AND DOCUMENTS CONTAINED HEREIN. PK BELIEVES
THAT ALL STATEMENTS MADE HEREIN ARE TRUE AND ACCURATE AND
HE HAS TAKEN REASONABLE PRECAUTIONS PRIOR TO PUBLISHING
SUCH INFORMATION.
